Information You Provide To Us
If you book a Service Order, and you choose to create a user account (“Account“) you will provide information that could reasonably be used to contact you or to identify you personally (such as your name, e-mail address, telephone number, mobile phone number, home address, and links to your social identities/networks, Account username and password, and credit card number (collectively, “Personal Information“)). In addition, a full history of your purchased Service Order(s) and warranty information is securely stored and accessible for future reference online through your Account. In addition, you will provide additional information in connection with the approval of an Estimate for a Service Order, such information will be combined with and stored with your Account information.
The Site may also ask you to provide other information such as a description of your particular service need and photos of the problem area (e.g., your appliance problem, your HVAC issue, etc.). This information, including your Personal Information, may be shared with the Service Professional that will be providing you with the service(s) booked by the Site.
If you do not want your Personal Information collected and used, please do not create an Account or book a Service Order.
Information We Collect Automatically
Whenever you visit or interact with the Site, EINSTEIN may use a variety of technologies that automatically or passively collect information about how the Site is accessed and used (“Usage Information“). Usage Information may include, in part, browser type, operating system, the page served, the time, the preceding and following page views, and your location. This statistical data provides us with information about the use of the Site, such as how many visitors visit a specific page on the Site, how long they stay on that page, and which hyperlinks, if any, they “click” on. This information helps us keep our website fresh and interesting to our visitors and tailor content to a visitor’s interests. Usage Information is generally non-identifying, but if EINSTEIN associates it with you as a specific and identifiable person, EINSTEIN treats it as Personal Information.
EINSTEIN may also automatically collect your IP address or other unique identifier (” Device Identifier“) for the computer, mobile device, technology or other device (collectively, “Device“) you use to access the Site. A Device Identifier is a number that is automatically assigned to your Device when you access a web site or its servers, and our computers identify your Device by its Device Identifier.
The technologies used on the Site to collect Usage Information, including Device Identifiers, may include:
Pixel tags. A pixel tag is a transparent graphic image, sometimes called a web beacon, clear GIFs or tracking beacon, placed on a web page or in an email, which indicates that a page or email has been viewed. In addition, a pixel tag may tell your browser to get content from another server.
We use Google Analytics to better understand how visitors interact with our site. This service provides non-personally identifiable data including but not limited to data on where visitors came from, what actions they took on our site and where visitors went when they left our site. Third Parties Providing Services On Our Behalf. In order to carry out your requests, to make various features, services and materials available to you through the Site, and to respond to your inquiries, we may share your Personal Information with third parties that perform functions on our behalf, such as companies or individuals that provide customer service and the Service Professionals who will be working on your Service Orders.
Business Transfers. We may share your Personal Information with other entities and affiliates in the family of companies under common control with EINSTEIN for internal reasons, primarily for business and operational purposes. As we continue to develop our business, we may sell or purchase assets. If another entity acquires us or all or substantially all of our assets, or assets related to the Sites, Personal Information, Usage Information, and any other information that we have collected about the users of the Sites may be disclosed to such entity as part of the due diligence process and will be transferred to such entity as one of the transferred assets. Also, if any bankruptcy or reorganization proceeding is brought by or against us, all such information may be considered an asset of ours and as such may be sold or transferred to third parties.
You may always direct us not to share your Personal Information with third parties, not to use your Personal Information to provide you with information or offers, or not to send you newsletters or promotional e-mails by: (i) sending us an e-mail at email@example.com; (ii) contacting us by mail at 4700 Millenia Blvd., Orlando, FL 32839 ; or (iii) following the removal instructions in the communication that you receive (e.g., the unsubscribe link at the bottom of an email). Your opt-out request will be processed within 30 days of the date on which we receive it. Of course, we will continue to have the right to email you concerning any matters pertaining to any Service Orders or your Account.
If you wish to verify, correct, or update any of your personal information collected through the Site, you may edit your profile preferences or contact us at the above address or e-mail. In accordance with our routine record keeping, we may delete certain records that contain Personal Information you have submitted through the Site. We are under no obligation to store such Personal Information indefinitely and disclaim any liability arising out of, or related to, the destruction of such Personal Information. In addition, you should be aware that it is not always possible to completely remove or delete all of your information from our databases without some residual data because of backups and other reasons.
We may also send you recurring text message communications to your mobile device relating to your booked service, your Account, and/or related promotional messages. If you would no longer like to receive such communications via text message, you may text STOP to 2146591660. We will send a text message confirming your opt out request. Your wireless carrier’s standard rates will apply to any text messages you send or receive.
We use certain reasonable security measures to help protect your Personal Information. However, no electronic data transmission or storage of information can be guaranteed to be 100% secure. Please note that we cannot ensure or warrant the security of any information you transmit to us, and you use the Site and provide us with your information at your own risk. We do not store the payment information that you provide to us (the “Payment Information”) other than that information which may be used to facilitate your retrieval of that information, including for example, the name you use to save the information under (e.g. “My Personal Card”), or the last four digits of your credit card. The Payment Information is stored with a third party who has advised us that it is PCI compliant.
The Site may contain links to other sites that we do not own or operate. This includes links to Service Professionals and their websites. We do not control, recommend or endorse and are not responsible for these sites or their content, products, services or privacy policies or practices. These other websites may send their own cookies to your Device, they may independently collect data or solicit Personal Information and may or may not have their own published privacy policies. You should also independently assess the authenticity of any site which appears or claims that it is one of our sites.
The Site and the services provided thereunder are governed by and operated in, and in accordance with the laws of the United States. EINSTEIN makes no representation that the Sites or the services thereunder are governed by or operated in accordance with the laws of any other nation. United States federal and state governments, courts, or law enforcement or regulatory agencies may be able to obtain disclosure of your information through laws applicable in the United States. By using the Site, or providing us with any information, you consent to the collection, processing, maintenance and transfer of such information in and to the United States and other applicable territories in which the privacy laws may not be as comprehensive as or equivalent to those in the country where you reside and/or are a citizen and waive any claims that may arise under those laws.
